Zgolj kasnejša sprememba stališča tožene stranke glede razlage materialnega prava ne utemeljuje uporabe izrednega pravnega sredstva odprave in razveljavitve oziroma spremembe odločbe po nadzorstveni pravici po drugem odstavku 88. člena Zakona o davčnem postopku (ZDavP-2). To velja tudi, če je taka sprememba stališča zapisana v obliki pojasnil ali navodil, izdanih s strani pristojnega upravnega organa. Uporaba navedenega pravnega sredstva zaradi kršitve materialnega prava v odmerni odločbi je mogoča tedaj, kadar se z njo zagotavlja pravilna uporaba prava Evropske unije (EU) v skladu s stališči, ki izhajajo iz sodb Sodišča EU. To velja tudi v primeru, da gre za tako utemeljeno kasnejšo spremembo stališča tožene stranke v zvezi z odmero davka na promet nepremičnin.

V družbi TAXIN d.o.o. (mag. Franc Derganc), partnerici Mreže Modro Poslovanje preučujemo davčno-pravna in druga poslovno-pravna vprašanja na podlagi študija sodne prakse Sodišča EU in slovenskih sodišč, preučevati moramo pravne predpise EU in domače pravne predpise ter spremljamo "potrebe" strank - podjetij, ki delujejo v Republiki Sloveniji ter na t.i. mednarodnih trgih.
