Upoštevanje naknadno predloženih dokazov je tako mogoče zavrniti le, če davčni zavezanec zamude ne pojasni, ali če gre za nedopustno zavlačevanje postopka, ki bi privedla do izgube davčnih prihodkov in če je imel davčni zavezanec v postopku možnost opredelitve do ugotovljenega dejanskega stanja davčnega organa pred izdajo zapisnika (načelo zaslišanja strank).

UPRS Sodba I U 1425/2023-25

Tožnica ugovarja, da je napačno razlogovanje toženke v izpodbijanem sklepu, da nima pravnega interesa za pritožbo zoper sklep ARSO 2016 zaradi odločitve v 3. točki izreka sklepa ARSO 2020. Sodišče pritrjuje tožnici v navajanju, da s sklepom ARSO 2020 (s katerim je bilo odločeno, da je za nameravani poseg - "Vgradnja povezovalnega kanala CO z dodajanjem armiranobetonske kinete..."- potrebno izvesti presojo vplivov na okolje in pridobiti okoljevarstveno soglasje) predhodni sklep ARSO 2016 (s katerim je bilo odločeno, da za nameravani poseg - "Izgradnja kanalizacije v okviru projekta "..."", ni treba izvesti presoje vplivov na okolje in pridobiti okoljevarstvenega soglasja) ni bil razveljavljen ali odpravljen (pa tudi s katerimkoli drugim sklepom ne). Sklep ARSO 2016 je torej kljub pravnomočnosti sklepa ARSO 2020 še vedno imel svoje pravno učinkovanje, zato toženka (zgolj) na podlagi pravnomočnega sklepa ARSO 2020 tožnici ni bila upravičena odreči vsebinske obravnave...

UPRS Sklep I U 1159/2023-9

S tem, ko je davčni organ izvedel odpis davčne obveznosti, obveznosti, ki je izhajalo iz izpodbijane odločbe, ni več, kar pomeni, da tožnik ni več zavezanec za njeno izpolnitev. Pravni učinki izpodbijane odločbe so bili odpravljeni z odpisom davčnega dolga. To pomeni, da je med postopkom prenehal pravni interes za odločitev o odpravi izpodbijane odmerne odločbe, ki ga je sicer tožnik imel ob vložitvi tožbe.

V družbi TAXIN d.o.o. (mag.
