VSRS sodba III Ips 108/2014

Tožeča stranka je od tožene stranke zahtevala plačilo zakonskih zamudnih obresti od neutemeljeno obračunanega DDV, zaračunanega z odpravljeno upravno odločbo. Podlaga zahtevka, ki ga uveljavlja tožeča stranka, ni v ZDavP-2. Po ZDavP-2 namreč postopajo davčni organi in nosilci javnih pooblastil, če so z zakonom pooblaščeni za pobiranje davkov (2. člen ZDavP-2), tožena stranka pa pri odmeri komunalnega prispevka ni nastopala v tej funkciji.

V družbi TAXIN d.o.o. (mag.
